Advocate contributes to international labour law 'Bible'

← Back to Info CentreAn Isle of Man Advocate has contributed a chapter to one of the leading employment law text books dealing with employee rights. The loose leaf book is called Business Transfers and Employee Rights by the eminent employment lawyer Dr John McMullen, visiting Professor of labour law at the University of Durham.
Advocate John Aycock of M&P Legal has written the Isle of Man chapter for the latest edition of this work. The primary purpose of the book is to explain the rapidly developing law that surrounds the Acquired Rights Directives of the European Union which in turn have led to the regulations governing employee rights in a business transfers known as TUPE the Transfer of Undertakings (Protection of Employment) Regulations.
The first edition of Business Transfers and Employee Rights was published in 1987 and has regularly been updated. The latest edition published in April 2012 not only explains the complicated TUPE laws and implications in the UK but also has chapters governing employee rights in transfer situations in no fewer than 32 other countries. The latest edition is the first edition to include a chapter on the Isle of Man transfer provisions. Mr Aycock's contribution outlines the Isle of Man law governing employee rights in a business transfer and highlights protective provisions of the Employment Act 2006 and the Redundancy Payments Act 1990. He distinguishes the position of the Isle of Man with the more complex law applicable in the UK.
Mr Aycock's contribution to this work is topical given that the recently published Review of the Scope of Government in the Isle of Man has referred to the employment law relating to transfers of business and makes a recommendation that the government should not seek to introduce TUPE legislation into the Isle of Man.
Mr Aycock is head of the employment unit at M&P Legal and some 20 years ago worked with the book's main author Dr McMullen while training as an employment lawyer in England. Mr Aycock is also qualified as a solicitor – advocate in England and Wales. The book is published by LexisNexis.
