Can I apply for a Grant of Probate without being in the Isle of Man
Posted on November 14, 2024
← Back to Info CentreIf you are an executor or administrator of an estate and you live overseas, you cannot personally apply for a Grant of Probate or Grant of Letters of Administration in the Isle of Man.
The Isle of Man Probate Registry requires an Isle of Man address for service in order to process an application for probate. This means that while you may be the named executor or administrator in the Will, you must either have a local representative or appoint someone with an Isle of Man address to submit the application on your behalf.
The reason for this requirement is that the Isle of Man has its own legal system, and the probate process involves certain formalities that need to be handled locally.
Executors or administrators from overseas can still be involved in the administration of the estate, but they will need to work with a local professional, such as an Advocate firm to ensure that the necessary legal requirements are met.
