Offshore funds and financial services

With experience of funds ranging in size from retail umbrella funds to small, private arrangements, the firm is well placed to service clients from within the Island's fund industry and from overseas. As well as acting as lead advisers in the establishment or re-structuring of funds, we are able to provide a specialist service to our clients and to overseas lawyers by advising on specific aspects of Isle of Man law which affect the establishment and operation of funds. Our lawyers also advise fund managers on the technical and practical steps to be taken before overseas schemes may be promoted in the Isle of Man. Though the use of an open-ended investment company as a fund vehicle continues to be a popular and flexible choice for many clients, the team at M&P Legal is equally experienced in establishing other fund structures including unit trusts and limited partnerships, whilst the use of a protected cell company as the underlying vehicle is also available. Following the introduction of new legislation in the Isle of Man, the former type of Experience Investor Fund is no longer available. However, Specialist Funds and Qualifying Funds have emerged as new sub-categories of exempt international collective investment schemes. There continues to be a demand for closed-ended investment structures, and we are able to advise on new and established structures and to take them through to a stock exchange listing.
